1. Changes to these terms and the Site

We change these terms from time to time. Whenever you wish to use our Site, please check these terms to ensure that you understand the terms and conditions that apply at that time.

We may change and update our Site from time to time to reflect changes in our products or the needs of our users.

2. Access to the Site

We cannot guarantee that our Site, or any content on it, will always be available or that use of the Site will be uninterrupted. We may suspend, revoke or limit the availability of all or part of our Site for business and operational reasons. We will attempt to notify you of suspension or revocation.

Users can create an account on the Site that allows them to view and track their orders, move through the payment process faster, save multiple shipping addresses, and more. Account holders usually have to choose a user identification code and password. You must treat such information as confidential and may not disclose it to third parties.

We have the right to disable any user identification code or password, chosen by you or assigned by us, at any time, if in our reasonable opinion you do not comply with the provisions of these Terms of Use. You acknowledge and agree that you remain responsible for any consequences arising from the use or misuse of your account credentials and that any instructions and actions sent through the Site are deemed to originate with you if your username and password have been used.

If you print, copy or download anything from our Site that violates these Terms of Use, your right to use our Site will immediately cease and you must (at our option, return or destroy any copies of the material you have created.

Where our Site contains links to other Third Party Sites and Resources, they are provided for information purposes only. Such links should not be construed as our approval of the linked websites or information you may obtain from them.

We have no control over the content of those Sites or resources.

6. Rules for linking to our Site

You may link to the homepage of our Site provided that you do so in a fair and legal manner and do not damage or abuse our reputation. You must not make a link in a way that suggests any kind of association, approval or permission on our part, where none exists.

You cannot establish a link to our Site on any website that is not owned by you.

We reserve the right to revoke the linkage authority without notice.

7. Our responsibility for any loss or damage suffered by you

SIf you are a consumer, please note that we only offer our site for your household and private use. You agree not to use our Site for commercial or business purposes and we will not be liable to you for any loss of profits, business losses, business stagnation or loss of business opportunities.

8. Upload content to our Site

Any content you upload to our site, including review of our products, is considered non-confidential and free-to-use information. You retain all your proprietary rights to your content but must grant us a limited license to use, store, copy and distribute the content and make it available to third parties.

We have the right to disclose your identity to any third party who claims that content posted or uploaded by you to our Site infringes their intellectual property rights or their right to privacy.

We have the right to delete messages you post on our Site if, in our opinion, your message does not meet our standard.

9. The security of our site

You are responsible for configuring your information technology, computer programs and platform to access our Site. You must use your own antivirus software.

You may not misuse our Site by knowingly entering viruses, Trojan horses, worms, logic bombs or other malware that is harmful or technologically harmful. 11. Our trademarks are registered

“ADVANTA”, “ECLIPSE” and “TOTAL ECLIPSE” are registered trademarks of(Angler Fishing Store or J.Simpson (Angler Fishing Store) Limited (a company within our group). You are not permitted to use it without our permission.

Part B – General terms and conditions of delivery

1. Conditions

These are the terms and conditions on which we deliver products to you that you purchase on the Site. Please read these terms carefully before submitting your order to us.

2. The agreement

2.1. A contract between us for the sale of our products will only be concluded when we accept your order.

2.2. When you place an order on the Site, we will send your order confirmation to the email address you provided. Please note that the order confirmation does not constitute our acceptance of your order. Here you will state an order number and tell you what you have ordered. When we accept your order you will receive an email with track and trace number so that you can use it to track your order on your account.

2.3. The acceptance of your order and the conclusion of the contract will take place when we indicate to you our acceptance of the order or, in the absence of such communication, when we ship the goods to you.

2.4. If we cannot accept your order, we will notify you and we will not charge you for the product/products. This may be because a product is out of stock, due to unexpected limits at our sources that we could not reasonably plan, because we identified an error in the price or description of the product or because we cannot meet a delivery deadline that you specified.

3. Our products and payment

3.1. The images of products on our site are for illustrative purposes only and your product may differ slightly from those images. The product descriptions on the Site, given in good faith, may be changed by us without notice or liability from us.

3.2. Materials and textures are approximate and can vary when viewed on different computing devices. The packaging of the product may differ from the image on our site.

3.3. Regularly, and at our sole discretion, the purchase of our products may be subject to special offers or promotions. All promotions or offers are subject to these terms and conditions. We may change or withdraw the terms of the promotions or offers, at any time and without notice.

3.4. The prices stated on the website include VAT.

3.5. We use Ideal, Amazon, PayPal Express and Klarna as our payment service providers. We accept both debit and credit cards from Mastercard and Visa. Customers using PayPal can make payments directly through their PayPal account.

3.6. You can pay for products on our Site with our gift cards. Our gift vouchers are valid for 24 months after the last activity, called requesting credit for example, but please note that you cannot supplement your card with additional credit if the card has expired. During checkout you will be asked to enter the 16-digit number on the back of the card. After you enter the gift card codes, your payment balance will automatically be updated with the value of the gift card(s).

3.7. If there is a balance you need, you can do it in the usual way with our normal payment providers (as stated in clause 3.5). If you do not spend the full value of the gift card(s), the rest will remain as a balance on the gift voucher so that you can spend it another time.

4. Delivery

4.1. The cost of delivery and estimated delivery times are displayed on our Site. Please note that we may change our shipping costs.

4.2. We deliver the goods to the address you provided during your order or to the address details in your account. The estimated delivery date will be as specified by us to you in the shipping email of your order.

4.3. We make every effort to deliver your products safely and in accordance with specific delivery instructions you give us, but we will not be liable for any delay, damage or loss resulting from compliance with such specific instructions.

4.4. If our range of products is delayed by events beyond our control, we will contact you as soon as possible to let you know and will take steps to minimize the effect of the delay. The condition is that we are not liable for delays caused by the event.

4.5. Goods (and risks to them) become your responsibility from the moment we deliver the goods to you at the address you specified (or otherwise in accordance with your delivery instructions).

5. Your rights to terminate the contract

5.1. If you terminate a contract for any reason set out in 5.1.1 to 5.1.3 below, the contract will terminate immediately and we will refund you the full amount for products that have not been delivered. The reasons are:

5.1.1. We have told you about an incorrect price or description of the product you ordered and you have informed us prior to shipment that you do not want to continue;

5.1.2. We have suspended delivery of the products, or notify you that we will suspend them, in either case for a period of more than 14 days;

5.1.3. You have a legal right to terminate the contract because of something we did wrong.

5.2. If you are a consumer, for most of the products you purchased on our Site, you have the legal right to change your mind and cancel the contract within 14 days and receive a refund. To exercise these rights, under the Consumer Contracts Regulations 2013, please email us at info@anglerfishingstore.com If you notify us after products have been shipped to you or you have received them, you must return them to us. You are responsible for the costs of returning the goods. We will process your refund within 14 days from the day we receive the products back and refund the price you paid for the products, including delivery costs, using the method you used for payment. However, we may make a reduction in the payment price if the value of the goods, due to your handling, decreases, so we are not allowed to reuse them or where the goods are in unsuitable condition or damaged packaging.

5.3. Please note that some products sold on our website are subject to spoilage, in such cases the usual consumer cancellation right (as set out in Article 5.2) does not apply. We also cannot allow consumers to cancel the contract if the purchased products are personalized or specifically customized for them or in accordance with their stated specifications.

6. Refunds and returns

6.1. We have a legal obligation to supply products that are in accordance with this contract. If you believe that a product you have received:

6.1.1. does not correspond to the description;

6.1.2. is not of sufficient quality;

6.1.3. does not comply with any relevant warranty we have given;

6.1.4. is defective or defective in some other way

you must then contact us as soon as possible at info@anglerfishingstore.com  or by phone at +1 (289) 908-7358 We reserve the right to send us reasonable proof of any product affected by such problems. Consumers who inform us of issues raised under this point 6.1 may, depending on individual circumstances, be entitled to a refund, repaired or substitute goods or be entitled to some money back.

6.2. Nothing in these terms affects your legal rights as a consumer.

7. Our responsibility for any loss or damage suffered by you

7.1. If we do not meet these terms, we will be responsible for any loss or damage you may suffer as a result of breaching our contract or failing to use reasonable care and ability, but we will not be responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is clear that this will happen or if, at the time the contract was concluded, we and you knew that this could happen, for example if you discussed it with us during the sales process.

7.2. We do not exclude or limit our liability to you in any way, where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or negligence on the part of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; for infringement of your legal rights in relation to the products, including the right to receive products that are: as described and match information we have provided to you and any sample you have seen or examined; of sufficient quality; fit for a particular purpose made known to us; and delivered with reasonable skill and care; and all rights under the Consumer Rights Act 2015.

7.3. We are not liable for business losses. We only supply the products for end users. If you use the products for commercial, business or resale purposes, we will not be liable for any loss of profit, loss of business, income or goodwill, business interruption or loss of business opportunities.

8. Other important conditions

8.1. We may transfer this agreement to someone else. We may transfer our rights and obligations under these terms to another organization. We will always tell you in writing if this happens and we will ensure that the transfer does not affect your rights under the contract.

8.2. You need our permission to transfer your rights to someone else. You may only transfer your rights or your obligations under these terms to another person if we agree to this in writing.

8.3. No one else has rights under this contract. This contract is between you and us. No other person has the right to enforce any of his terms.

8.4. If a court finds part of this contract illegal, the rest will remain in effect. Each of the paragraphs of these terms and conditions works separately. If a court or relevant body decides that one of them is unlawful, the remaining paragraphs remain fully binding and legally valid.

8.5. Even if we are delayed in enforcing this contract, we can enforce it later. If we do not immediately insist that you should do something you are required to do under these terms, or if we are delayed in taking any action against you regarding your breach of contract, that does not mean that you do not have to do those things and this does not prevent us from taking action at a later date. For example, if you miss a payment and we do not pursue you, but we continue to deliver the products, we may still require you to make the payment at a later time.

8.6. Use of your personal data. We will only use your personal information in the ways set out in our Privacy Policy, which you can find here.

8.7. Applicable laws. These terms are subject to English law and you may take legal action in respect of the products in English and Welsh courts.

Promotion Code General Terms and Conditions

Promo codes are only valid for orders placed online unless otherwise stated.

Promo codes entitle you to a saving on a new order placed with Angler Fishing Store at the time of ordering.

Angler Fishing Store the right to refuse orders if, in its opinion, a promotional code is invalid before placing the order.

Promotional codes are only valid for specific products while supplies last and can be withdrawn at any time. Exclude all financial deals and transactions, delivery fees and gift card purchases.

Promotional codes are not valid in combination with other promotions. Offer is not valid on sale items or other competitively priced items.

In the case of return of an item, the original purchase amount will be refunded after deduction of discount (if applicable), any shipping, gift wrapping or gift card fees.

In the event that part of the order is returned, the value of the discount applied to that order will be distributed proportionately among the goods. The amount in cash exceeding this value, less the shipping, gift wrapping or gift voucher fees charged on the original order, will be returned to the customer. The promotional discount will not be applied to replacement items, if the offer is still valid at the time of return, you will need to place a new order with the original promotional code.

In the event that part of the order is returned, the value of the promotional code is divided equally between the goods. The cash amount exceeding this value, less any delivery charges or gift packaging charges charged on the original order, will be returned to the customer.

In the case of returns, this means that the order is no longer eligible for the advertised promotion, Angler Fishing Store reserves the right to deduct the discount from the offer from the refund.

Free delivery offers only apply to standard delivery in the European Union.

For promotions where there is a free or half price item when buying multiple items, please note that the discount will be applied to the cheapest item.

Angler Fishing Store reserves the right to change these General Terms and Conditions at any time.

Promo codes found in Angler Fishing Store brochures only apply to items advertised in the brochure.

E-Gift Vouchers

Shop the website as usual and then go to the payment page. During checkout you will be asked to enter a 16-digit code.

For multiple email gift vouchers, enter one code at a time.

After entering the receipt code, the order amount is automatically updated after deducting the receipt (s) value. If there is still an amount open to pay, you can use a debit or credit card in the usual way.

If you do not spend the full amount of the receipt (s), the remainder will remain as balance on the email gift card so that you can spend it another time. Your gift voucher is valid for 24 months after receipt, but please note that you cannot supplement your gift voucher with an additional credit if the card has expired.
